• Customers: Can discover, activate, and use AI agents
• Users can have both roles with a single account

4. Developer Responsibilities

• Developers are responsible for the quality and functionality of their agents
• Agents must comply with our content and technical guidelines
• Developers must provide accurate descriptions and pricing information
• Agents must not violate any laws or third-party rights

4.2 Agent Performance

• Developers must maintain reasonable uptime and performance
• Agents must handle errors gracefully and provide meaningful responses
• Developers are responsible for agent security and data protection
• Agents must not cause harm to users or the platform

4.3 Revenue and Payments

• Developers receive a percentage of revenue from agent usage
• Payments are processed through Stripe Connect
• Developers must comply with Stripe's terms and requirements
• Revenue calculations are based on actual usage metrics

5. Customer Responsibilities

5.1 Agent Usage

• Customers must use agents in accordance with their intended purpose
• Customers are responsible for the data they provide to agents
• Customers must not attempt to reverse engineer or exploit agents
• Customers must comply with rate limits and usage guidelines

5.2 Payment Obligations

• Customers must pay for agent usage according to published rates
• Payments are processed automatically through Stripe
• Customers are responsible for maintaining valid payment methods
• Refunds are handled according to our refund policy

6. Platform Rules and Guidelines

6.1 Prohibited Content

• Illegal, harmful, or offensive content
• Content that violates intellectual property rights
• Content that promotes discrimination or harassment
• Content that could cause harm to users or systems

6.2 Acceptable Use

• Use the platform for its intended purpose
• Respect other users and their rights
• Follow technical guidelines and best practices
• Report issues and violations promptly

7. Payment and Billing

7.1 Pricing and Fees

• Agent pricing is set by developers
• Platform fees are calculated as a percentage of usage
• All prices are displayed in USD unless otherwise specified

7.2 Payment Processing

• Payments are processed securely through Stripe
• Invoices are generated monthly for customer usage
• Developers receive payouts according to Stripe Connect schedules
• Payment disputes are handled according to Stripe's policies

8. Intellectual Property

8.1 Platform Rights

The Platform and its content are owned by Inogentiq and protected by intellectual property laws.

8.2 User Content

• Developers retain ownership of their agents and content
• Customers retain ownership of their input data
• Users grant us license to use content for platform operations
• Users are responsible for ensuring they have rights to their content

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers and Limitations

You agree to indemnify and hold harmless Inogentiq from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

• You may terminate your account at any time
• We may terminate accounts for violations of these Terms
• Termination does not affect obligations incurred before termination
